Sailing alone one night off the coast of New Jersey many years ago, I was guided by lights blinking at regular intervals on the shore. Some blinked once every 4 seconds. Some once every 6. Each could be identified by the characteristic of its light and its position fixed on my chart. By their reliable constancy I was able to sail beyond Sandy Hook and enter New York Harbor safely.
Lighthouses have guided navigators for thousands of years.
Lighthouses of one kind or another are essential to keep civilization on course.
Justice herself has Lighthouses … fixed lights set securely on the solid foundation of prudence to guide decisions in our highest courts.
One is that no person should be compelled to testify against himself.
Another is that each should be presumed innocent until proven guilty beyond a shadow of doubt.
There are many others known and (unfortunately for all of us) far too many not well known but equally important. Lights that should be known by each of you. Lights your government should teach you at no cost to you. Lights you should know so you can force judges to secure Justice for absolutely ALL of us (the unfulfilled dream we’ve been promised for far too many generations).
None should be permitted to testify to what was said by someone not in court, for such testimony is inherently unreliable.
Judges at a hearing on a motion should permit no argument that does not address matters raised by the motion.
Circumstantial evidence is not “evidence”, because it can never be certain and therefore can never be proof.
None should be held liable for unforeseeable consequences to one’s actions or failures to act.
There are dozens more, but none are part of our conversations these days!
None are taught to our children nor to you!
The consequence is that our Ship of State is in danger of foundering for lack of wise navigators on the benches of our courts guiding their decisions by these never-changing Lighthouses that today are too often forgotten or intentionally ignored.
We need fixed Lighthouses to guide us and our leaders toward that happy harbor where finally there may Justice for us ALL.
Public opinion or the ever-changing political climate cannot provide us with the Lighthouses we need to guide and control those who administer Justice in our courts where they decide the constitutionality and morality of decisions of Congress and our state legislatures.
We need to identify once more those Lighthouses that the people may trust and wholeheartedly embrace. We must resurrect them from the tombs of dusty old books where they’ve lain forgotten far too long.
