The Game of Court …

Every case is just a “game”.

It can be a very serious game.

But, it’s a very simple game and one that everyone of you can quickly learn to win!

Every case (civil or criminal) is like a game of checkers or most card games. One side makes a play, then the other side is REQUIRED to make an opposing play. The game goes back-and-forth … one play at-a-time … until one side wins.

See the game this way and the pieces begin to fall neatly into place.

The game begins when one side makes a play. The other side MUST RESPOND with a countering play. The parties go back-and-forth, each responding to the other, putting their plays in the court’s official record. There’s no hiding. No refusing to play.

The game proceeds until one side presents sufficient evidence to prove that some LAW requires the umpire (judge) to sign an order awarding the winner.

In every criminal case, the prosecutor alleges FACTS that defendant did certain unlawful things. Defendant responds by presenting evidence to show that the prosecutor cannot prove what he alleged beyond any reasonable doubt or that there is another way to look at the evidence that does not implicate defendant. If defendant succeeds, the LAW requires the judge to sign an order setting defendant free. Otherwise the LAW requires the judge to sign an order requiring defendant to pay a fine or be imprisoned.

In every civil case, the plaintiff who started the case alleges FACTS that (if proven) trigger LAW that requires the judge to grant favorable judgment. Defendant must admit or deny every fact the plaintiff alleges. The game continues until one side presents sufficient evidence to trigger a LAW that requires the judge to sign an order awarding him a favorable judgment.

It’s that simple.

The pieces on the board are FACTS, LAW, and the RULES that control how the game is played to win.
