Stuff that Exists

At one end of the reality spectrum is stuff that exists or existed at some time in the past … stuff that is “real”.

At the other end of the reality spectrum is stuff that does not exist and never existed. It may exist in the future. It may be imagined. It may be hoped for. But, Justice does not concern itself with stuff that isn’t “real”.

The Rules of Evidence keep it OUT.

Think of the evidence rules as filters. They “admit” stuff that reasonable persons would believe to be real. They keep other stuff out if you know how to use the rules to compel judges to keep it out!

Every civil and criminal case is won (or lost) on the stuff that gets admitted to the court’s official record. The evidence rules decide what comes “in” and what stays “out”.

These powerful rules are enforced with “objections”.

Objections compel judges to keep the record clear of stuff that isn’t real.

Objections must be made promptly before an evidence rule is ignored. They must keep the wrong stuff out before it comes in.

You can’t un-ring a bell.
