What every civilized nation owes its populace—citizen or not.
The exercise of state power, in a civilized nation, must be limited in scope and severity.
Each person under authority must be guaranteed the security of due process according to fixed reasonable rules that apply equally to all persons with no exception.
Those reasonable rules (that must apply equally to all persons with no exception) are the Rules of Court Procedure and the Rules of Evidence … fully explained and outlined with sample forms in the Jurisdictionary® course “Key to the Courthouse”.
At a minimum those fixed rules and their enforcement must afford the following guarantees to each and every person impacted by the state’s power:
– Reasonable advance notice of proceedings.
– Opportunity to be heard and argue in support of oneself.
– Power to summon witnesses in support of oneself.
– Power to command production of documents and things in support of oneself.
– Privilege to refuse to testify against oneself.
– Ability to do these things without the prohibitive cost and foreseeable risk of hiring a lawyer.
To deny due process to any person within the political boundaries of a nation is to undermine, corrupt, and de-legitimize that nation’s legal system and pave the way for open tyranny in high office.
The Rule of Law and the promise of Liberty and Justice to all are hollow words without meaning in a nation with no certain guarantee of due process for all persons at all times under all circumstances.
When a nation denies due process to any person under its authority, the Spirit of Liberty must call and command its people to take immediate action to repair the breach and expel from leadership those people responsible for this crime against humanity.
