Common law is not what many people think it is.
To win in court you need to know the truth.
Common law is not some unwritten ancient code controlling how judges should rule today, as many misinformed people insist.
Those people lose needlessly lose in court by not knowing what common law is.
Sadly, there are social media “movements” asserting this lie.
Common law is not an ancient code of legal precepts.
Common law is the sum total of published appellate court decisions that have not been revised or reversed by more recent appellate decisions.
Those published appellate court decisions are LAW, just as effective as statutes and constitutions.
When a law created by an appellate court decision is “controlling”, i.e., where the deciding appellate court is directly above the trial court, the judge of that trial court must obey. Failure to obey is appeallable error.
In recent years an angry anti-authority voice promotes this and other mis-information about our American Heritage of constitutional law and its influence on our lives and livelihoods. That lying voice suggests the authority of our courts is being subverted by insidious political powers intent on enslaving us by denying our due process rights.
The reality, as Jurisdictionary® knows well, is that those promoting this idea are people who have no idea what due process really is. They have no idea how to draft a proper pleading. No idea how the evidence rules filter facts. No idea how, why, or when to make proper objections to preserve the record for appeal. And no idea what common law really is.
Part of our collective responsibility as citizens in a civilized society is to call down ignorance.
To do so effectively, of course, requires first knowing the Truth.
