How to Cite the Law

To win in court case you must know the law that favors your cause, the law that requires the judge to rule in your favor.

You must also know how to cite the law properly. This mini-course shows how.

Law may be found in:

  • Statutes and Codes
  • Constitutional Provisions
  • Published Appellate Opinions (common law)
  • Rules of Court (procedure, evidence, etc.)
  • Rules of Juridical Reasoning
  • Advisory References (law review articles, scholarly works, etc.)
Cite the Law

You must cite the law properly in your paperwork or risk being ignored.

There’s a right way and a wrong way to do this.

Know the right way.

If you want a judge to enforce a law, you must tell the judge (with proper citations) what the law is.

You must also tell the judge where that law can be found in the official records.

That’s what proper citations do.

Proper citations identify the law and tell where the law may be found.

Telling a judge, “I found a case on AI where Jones sued Smith and won,” isn’t going to get you very far. There are thousands of cases between Jones and Smith. The court needs to know which one and where to find the official version!
